1. Scope
These Terms apply to audio and project information submitted to Kirin Mastering for mastering work. Project-specific details remain subject to what Kirin Mastering and the client confirm for that project.
2. Rights in submitted material
Rights in audio, project information, production notes, and other submitted material remain with the client or the relevant rights holder. The client confirms that the client has the rights or permission needed to provide the material for mastering.
3. Confidential handling
Submitted audio, unreleased project information, production notes, and communications are handled only as needed to respond to the inquiry and perform the mastering work. How a project may be referred to publicly will be confirmed with the client.
4. Retention and deletion
The client may contact Kirin Mastering to request deletion of submitted audio after the work is complete. Kirin Mastering does not guarantee long-term archival storage. The client should keep backups of the original audio and delivered files.
5. Responsibility
Kirin Mastering performs the work from the material and instructions supplied by the client. The client makes the final approval and release decision.
To the extent permitted by applicable law, liability for direct and ordinary loss caused by Kirin Mastering's ordinary negligence is limited to the amount paid for the project concerned. This limit does not apply to intentional conduct, gross negligence, or liability that cannot lawfully be limited.
